Copyright or patent for doll? Which?
I’m trying to figure out how to protect my dolls before i start to sell them online. I make them out of cloth, and I needle-sculpt the face. I drew and tweaked my own pattern. The nature of needle-sculpting is such that every doll will be a bit different. A doll will even be different depending on what type of fabric I use for it. but I use the exact same pattern and method of stuffing. How can I keep people from stealing my pattern? I’m not sure where to go from here before I start to sell them. I need to sell the ones I have to get money for materials to make more. but I was told not to sell the ones I have until they have been patented to protect them. I’m confused.
You would copyright the design.
A patent would protect you if the dolls had a totally new function.
Copy the design, and mail it to yourself. Don’t open it when it arrives. Then, if there is a legal issue down the road, you can present the unopened letter to the court with its postmark as proof of your copyright.
